The Civil Partnership Act 2004 came into force on 5 December 2005. Civil Partnerships are legal relationships which can be registered by two people of the same sex and give the couple’s legal recognition for their relationship.

Same-sex couples who register a civil partnership will have the same rights and recognitions in a wide range of legal matters as opposite-sex couples who enter into a civil marriage.

Prior to marriage and civil partnership in the UK, Foreign Nationals (that is anyone who is not a British citizen, or does not hold ILR or Right of Abode) must now apply for a Certificate of Approval before giving notice to marry. (Please see Certificate of approval sub title). This is applied for through the Home Office and must be issued before a wedding may take place. In order to apply for a Certificate of Approval a person must hold leave to remain in the UK that was initially issued for longer than 6 months and that currently has at least 3 months remaining before expiry.
